What Is an Accessory Dwelling Unit?

An Accessory Dwelling Unit (ADU) is an independent habitable living unit with its own:

• Kitchen
• Bathroom
• Separate entrance

An ADU may be:

• Within or attached to a single-family home
• Located above a detached garage
• Built as a detached accessory structure on the same single-family lot

Motor homes, fifth-wheels, travel trailers, campers, and other housing units on wheels are not considered ADUs.

ADUs are only allowed in single-family homes and are not permitted in townhomes, duplexes, apartments, or other multi-family dwellings.

ADU Standards

The Eagle Mountain Municipal Code includes standards intended to help ensure ADUs remain secondary to the primary residence while addressing health, safety, and neighborhood compatibility.

Some of the key requirements include:

• Only one ADU is allowed on a residential lot.
• The property owner must live in either the primary home or the ADU, except during bona fide temporary absences.
• ADUs must comply with applicable building and fire codes.
• Off-street parking is required for ADU occupants.
• ADUs may not be rented for periods of less than 30 consecutive days.

When Is an ADU Permit Required?

An Accessory Dwelling Unit (ADU) permit is required if you are:

• Constructing a residence with an ADU
• Remodeling a residence to create an ADU
• Bringing an existing ADU that has not been permitted into compliance

An ADU permit is required in addition to any applicable building permits. ADUs constructed without an approved permit are considered illegal until a permit application has been submitted to and approved by the City.

What You’ll Need to Apply

Before submitting your application through Eagle Mountain City’s online ADU application, gather the following information.

Site Plan

Your site plan should include:

• Property lines
• Property dimensions
• Existing buildings and building entrances
• Proposed buildings or additions
• Dimensions from buildings to property lines
• Location and dimensions of two off-street parking spaces
• Utility meter locations
• A 36-inch-wide unobstructed egress path from the ADU exit to the street or public right-of-way (sidewalk)

Floor Plan

Your floor plan should include:

• A detailed floor plan drawn to scale
• The floor where the ADU will be located
• Labeled rooms showing their intended use
• Kitchen sink location
• A 220-volt outlet or gas line for the stove

Application Fee

The ADU permit application fee is $230.

Building Permit

Evidence of a building permit is not required to submit an ADU application, but it is required to maintain compliance.
