1. Introduction

This Terms of Use agreement (“Terms”) governs your access to and use of eaglemountain.gov (the “Site”), the official website of Eagle Mountain City, Utah (“the City,” “we,” “us,” or “our”). These Terms address how you may use the Site. For information about how the City collects and handles personal information, please refer to the Eagle Mountain City Privacy Policy, which is incorporated into these Terms by reference.

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Site.

2. Purpose of the Site

eaglemountain.gov is operated as a public service to communicate information about City government, services, programs, public meetings, community events, and other municipal matters. The Site is informational in nature and is not intended to serve as a substitute for legal, financial, engineering, or other professional advice.

3. No Legal or Professional Advice

Information published on the Site — including ordinances, code references, fee schedules, public notices, project updates, and FAQs — is provided for general informational purposes. While the City makes reasonable efforts to keep content current and accurate, official records on file with the City Recorder, formally adopted ordinances, and decisions of the Mayor and City Council shall control over any conflicting or outdated information on the Site.

You should not rely solely on the Site when making legal, financial, business, or property decisions. For binding determinations, contact the appropriate City department directly.

4. Acceptable Use

You may use the Site only for lawful purposes consistent with these Terms. You agree that you will not:

5. Intellectual Property

5.1 City Content

The Site and its original content — including but not limited to text, graphics, logos, icons, photographs, video, audio, code, page layouts, and the overall “look and feel” — are owned by Eagle Mountain City or its licensors and are protected by United States copyright, trademark, and other intellectual property laws.

5.2 City Marks

The name “Eagle Mountain City,” the Eagle Mountain City seal and logo, the 30th Anniversary logo, “Pony Express Days,” “Trailhead Magazine,” and other City names and identifiers are the property of Eagle Mountain City. You may not use these marks for commercial purposes, to imply endorsement, or in any manner likely to cause confusion as to source or sponsorship, without prior written authorization from the City’s Communications Department.

5.3 Permitted Use of Public Information

Public records and government works produced by the City may generally be reproduced for non-commercial, informational, educational, or journalistic purposes, provided that:

Photographs, illustrations, third-party content, and licensed materials appearing on the Site may be subject to separate copyrights and licensing terms. Where third-party material is identified as such, you must obtain permission from the original rights holder before reuse.

5.4 Reporting Infringement

If you believe content on the Site infringes a copyright you own, please contact the City Recorder with a written description of the work and the location of the alleged infringement on the Site.

6. User Submissions

Certain features of the Site may allow you to submit comments, applications, service requests, public-comment forms, surveys, or other content (“User Submissions”). By making a User Submission, you represent that:

You grant Eagle Mountain City a non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, adapt, publish, and display your User Submission in connection with the operation of City government, the delivery of municipal services, and public communications.

User Submissions to the City may constitute government records subject to disclosure under the Utah Government Records Access and Management Act (GRAMA), Utah Code § 63G-2. Refer to the Privacy Policy for additional information on how submissions are handled.

7. Public Comment Standards

Where the Site provides a forum for public comment or interactive feedback, comments must be relevant, respectful, and lawful. The City reserves the right, but assumes no obligation, to review and remove any User Submission that:

Removal of content does not constitute viewpoint discrimination, and the City strives to apply these standards in a content-neutral manner consistent with the First Amendment.

8. Disclaimer of Warranties

THE SITE AND ALL CONTENT, FEATURES, AND SERVICES PROVIDED ON OR THROUGH IT ARE OFFERED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

Eagle Mountain City expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. The City does not warrant that:

9. Governmental Immunity and Limitation of Liability

Nothing in these Terms shall be construed as a waiver of any defense, immunity, or limitation of liability available to Eagle Mountain City, its officials, officers, employees, agents, or volunteers under the Utah Governmental Immunity Act, Utah Code § 63G-7-101 et seq., or any other applicable federal, state, or local law.

To the fullest extent permitted by law, in no event shall Eagle Mountain City or its officials, officers, employees, agents, or volunteers be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages — including, without limitation, damages for lost data, lost profits, business interruption, or loss of goodwill — arising out of or relating to:

This limitation applies regardless of the legal theory on which the claim is based, whether in contract, tort, statute, or otherwise, and even if the City has been advised of the possibility of such damages.

You agree to indemnify, defend, and hold harmless Eagle Mountain City and its officials, officers, employees, agents, and volunteers from and against any claims, demands, liabilities, damages, judgments, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

11. Suspension and Termination of Access

Eagle Mountain City reserves the right, in its sole discretion and without prior notice, to suspend, restrict, or terminate your access to the Site — in whole or in part — for any reason, including suspected violation of these Terms, abuse of City systems, or to preserve the integrity, security, or availability of the Site for other users.

The City may also take administrative, civil, or criminal action against any user who attempts to damage, disrupt, or gain unauthorized access to the Site, consistent with applicable federal and Utah law, including the Utah Computer Crimes Act, Utah Code § 76-6-701 et seq.

12. Governing Law and Venue

These Terms are governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Utah County, Utah, and you consent to the personal jurisdiction of those courts.

These Terms are not intended to create — and shall not be construed to create — any private right of action against the City beyond those already available under Utah law.

13. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be unlawful, void, or unenforceable, that provision shall be severed from the remaining provisions, which shall continue in full force and effect.

14. No Waiver

The failure of Eagle Mountain City to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. No waiver shall be effective unless made in writing and signed by an authorized representative of the City.

15. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms or notices posted on specific pages of the Site, constitute the entire agreement between you and Eagle Mountain City concerning your use of the Site, and supersede any prior agreements or understandings on that subject.

16. Changes to These Terms

Eagle Mountain City reserves the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
